 GENERAL CONDITIONS OF SALE

Acceptance of the general conditions of sale and conclusion of the Agreement.

The agreement stipulated between Trakatan \ 8-30 srl and the Customer (i.e. the individual, natural person, who makes the purchase on the site, not related to his/her own trading or business) shall be deemed concluded with acceptance, even partial, of the order by Trakatan \ 8-30 srl. In the event of the order not being accepted, Trakatan\8-30 srl will inform the Customer of this as soon as possible.

By placing an order, the Customer acknowledges that he/she has read all the information provided during the purchase procedure and accepts the terms and conditions stated here in their entirety.

These Conditions can be printed or saved on a durable medium, in compliance with art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Method of purchase

The products sold by Trakatan\8-30 srl are solely those present on the website trakatan.com at the time when the Order is placed, as described in the related information.

It is to be understood that the images used to present the products are for the purposes of information alone and may not be fully representative of the product, differing in terms of color and size for example (also in view of the browser and monitor used to visualize the images).

To place an Order, the Customer must follow the instructions in the “Shop” section until the final check out including payment, or fill out the relevant form on the Site in the Atelier section and submit it after carefully viewing these Conditions, as well as the characteristics of the product(s) he/she intends to buy. If required, the Customer must also ask Trakatan \ 8-30 srl to issue a tax invoice for the purchase, pursuant to art. 22 D.p.R. n. 633/1972.

Receipt of the Order is confirmed by Trakatan \ 8-30 srl by e-mail, sent to the e-mail address communicated by the Customer. This confirmation email summarizes the purchase conditions, as required by the relevant legislation, as well as the information entered by the Customer, to enable the latter to verify the information and make any necessary corrections without delay.

The personal data gathered when the Order is placed will be processed by Trakatan \ 8-30 srl for the sole purpose of fulfilling the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy notice on the site. Any further processing will be carried out only with the express consent of the Customer.

Governing law

The sales agreement referred to in these Conditions is governed by Italian Law, and shall not be governed by the provisions of the United Nations Convention on Contracts for International Sales of Goods. For any disputes, the place of jurisdiction is the Law Court of Turin.

All the trademarks, logos and other distinctive symbols used on the site belong to their respective owners. The use of trademarks, logos and other distinctive symbols is prohibited, including reproduction on other websites by unauthorized third parties. The contents of the site are protected by copyright (texts, images and graphics).

Agreement

This agreement replaces all contracts and agreements previously entered into between the parties and represents the totality of the agreement between the parties regarding the subject of the agreement, together with the order, the general conditions relating to the use of the site and the conditions regarding the registration service. Any change or modification of this agreement must be accepted in writing by both parties.

Communications

All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. Communications sent to the e-mail address of the other party, indicated on the website and in the order, are deemed communications in writing.

Communications relating to the validity or existence of this agreement must be delivered by hand or sent by registered letter with return receipt.
